Thermic does not guarantee that customer reviews accurately represent the experience of every customer.

Customers must not submit false, misleading, fraudulent, defamatory, or fabricated reviews.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE THERMIC WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

THERMIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, THAT MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THERMIC DOES NOT WARRANT THAT THE WEBSITE, SERVICES, CONTENT, OR WEBSITE FUNCTIONS WILL ALWAYS BE AVAILABLE, SECURE, ACCURATE, COMPLETE, UNINTERRUPTED, OR ERROR-FREE.

NOTHING IN THIS NOTICE DISCLAIMS OR LIMITS ANY WARRANTY OR CONSUMER RIGHT THAT CANNOT LEGALLY BE DISCLAIMED OR LIMITED.

12. Product Use

Customers are responsible for using Thermic products in accordance with applicable instructions, warnings, care guidance, and reasonable safety practices.

Thermic products should not be used for purposes for which they were not designed.

Thermic is not responsible, to the extent permitted by law, for damage or injury resulting from misuse, abuse, modification, unauthorized alteration, improper maintenance, failure to follow applicable instructions, or use contrary to product warnings.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THERMIC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, SERVICE PROVIDERS, AND BUSINESS PARTNERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, PURCHASE OR USE OF PRODUCTS, WEBSITE ACCESS, ORDER, SHIPPING, CANCELLATION, RETURN, OR OTHER TRANSACTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THERMIC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR TRANSACTION SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID TO THERMIC FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

This limitation does not apply to liability that cannot legally be limited or excluded under applicable law.

14. Carrier and Third-Party Responsibility

Thermic may rely upon independent third parties for payment processing, fulfillment, shipping, delivery, technology, hosting, and other services.

To the maximum extent permitted by applicable law, Thermic is not responsible for failures caused exclusively by independent third parties after Thermic has properly performed its obligations.

Shipping-related matters are further governed by Thermic's Shipping Policy.

15. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Thermic and its owners, officers, employees, contractors, agents, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable legal expenses, arising from:

• Your unlawful or unauthorized use of the Services.

Such circumstances may include natural disasters, severe weather, fire, flood, epidemic or pandemic events, governmental actions, war, terrorism, civil unrest, labor disputes, transportation disruptions, supply-chain disruptions, utility failures, internet or technology failures, carrier disruptions, customs delays, or other events beyond Thermic's reasonable control.
